By using or advertising with the Touch Yorkshire Property web site, you are agreeing to Terms and Conditions as described below.

Definition of Users

User: A person or persons using the Touch Yorkshire Property web site in search of properties or services.

Advertiser: An estate agent or private individual advertising property/ies within the Touch Yorkshire Property database or a company advertising services or products via banners etc; on the Touch Yorkshire Property web site.

Terms and Conditions for Advertising

•    Touch Yorkshire Property reserves the right to alter or amend any advertisement submitted by advertisers.

•    Touch Yorkshire Property cannot be held responsible for loss or damage to the advertiser for any reason whatsoever.

•    Touch Yorkshire Property accepts no responsibility of any nature for the content of the advertisement. (See Legal notice and disclaimer below)

•    Touch Yorkshire Property reserves the right to delete any advertisement it considers abusive, offensive, misleading or in breach of applicable law or regulation. No refunds will be given in this instance.

•    Advertisers are entirely responsible for all content and postings to the Touch Yorkshire Property web site.

•    Touch Yorkshire Property cannot be held responsible for any copyright infringement resulting from material supplied by an advertiser. The advertiser warrants that they the Company are the owner of the copyright and indemnifies Touch Yorkshire Property against any action for breach of copyright. (See Indemnity policy below)

•    Touch Yorkshire Property reserves the right to refuse any advertisement for inclusion in its database or web site.

   Accounts and passwords are the responsibility of the advertiser (subscriber) and must be kept secure and confidential at all times, Touch Yorkshire Property does not accept responsibility for activities occurring as a result of unauthorised access.  You must contact us immediately in the event that your account or password has been compromised.

Cancellation and Refund Policy

If for any reason, you are unsatisfied with our service, please contact us and we will make every effort to rectify the situation.

In the event that you wish to cancel your advertising, you must do so in writing and provide a months notice. Any remaining balance will be refunded pro rata.

The Advertiser or user will fully indemnify Touch Yorkshire Property from and against all claims, demands, actions, losses, damages, costs, charges, fines and expenses arising from or incurred due to: (a) any infringement or alleged infringement of any third party Intellectual Property Rights (defined below) caused by Touch Yorkshire Property use (pursuant to this Agreement) of the Advertising Content provided by the Advertiser; or (b) the Advertiser providing any Advertising Content which is obscene, blasphemous, or defamatory or otherwise in breach of any applicable law or regulation.

For the purposes of this Agreement, "Intellectual Property Rights" means patents, trade marks, service marks, design rights (whether registered or otherwise), applications for any of the foregoing, copyright, database rights, know-how, trade or business names, domain names and other similar rights or obligations whether registered or not in any country.

Web Site Maintenance and Access

For the purpose of web site maintenance and the introduction of new features or updates, Touch Yorkshire Property may occasionally suspend or restrict your access to the website. We will endeavour to keep any suspended or restricted access to the web site as infrequent and short as possible.

Whilst we attempt to ensure that any material available for downloading from this Site is not contaminated in any way, we do not warrant that such material will be free from infection, viruses and/or similar code.

Due to the nature of software and the internet, we do not warrant that your access to, or the running of, this Site will be uninterrupted or error free. We shall not be liable if we cannot process your details due to circumstances beyond our reasonable control.
